WEST HEMPFIELD TOWNSHIP SUPERVISORS’ MEETING

                                                        Minutes of March 1, 2011

 

The regularly scheduled meeting of the Board of Supervisors was held at the Township Municipal Office, 3401 Marietta Avenue, Lancaster, Pennsylvania on Tuesday, March 1, 2011.  Chairman David Dumeyer and Board members Frank Burkhart, Edward Fisher, Anthony Crocamo and Kent Gardner were present.  Also in attendance were: Ron Youtz, Township Manager; Edward Hinkle, Zoning Officer; Mark Pugliese, Chief of Police; Dale Getz, Public Works Director; and Sandra Mullin, Recording Secretary.

 

I.    Call to Order

 

Chairman David Dumeyer called the meeting to order at 7:30 p.m. with the Pledge of Allegiance.

 

II. Approval of Minutes

 

Motion: Frank Burkhart moved to approve the minutes of February 1, 2011 as presented; seconded by Edward Fisher.  Carried 5-0.

 

III. Communications

 

A.  Board of Supervisors

 

Kent Gardner advised that the Lancaster Inter-Municipal Committee is in the process of arranging a workshop for MS4 compliance.

 

David Dumeyer presented Commendation Awards on behalf of the Board of Supervisors to Officer Richard C. Bowermaster, Jr. and Bradley J. Rohrbaugh for their handling investigations that led to multiple arrests and successful prosecutions.  Mr. Dumeyer then presented the 2010 Officer of the Year Award to Richard C. Bowermaster, Jr., an 8 year veteran of the police department who has conducted his investigations with dedication and tenacity, bringing credit to himself and the department. Board members congratulated each officer, thanking them for their service to the community and expressing pride in their conduct.

 

B.  Township Manager

 

Ron Youtz reminded board members about the upcoming LCATS dinner at Four Seasons on Thursday, March 31st and asked them to register with either he or Sandy Mullin if they were interested in attending.

 

Ron Youtz reported that staff is working on articles for the spring newsletter.

 

C.  Residents

 

Ken Lang, referenced letters of support from his neighbors which he had distributed to board members

several months ago.

 

Mr. Dumeyer recognized the following students who were present as a requirement of their government

class at Lancaster Catholic High School and thanked them for their attendance:  Anthony Juliano, 735

Steeplechase Drive, Shaun Gibbons, 2791 Ironville Pike, Ericka Diffendall and Lauren Christy, 3600

 Falcon Court.

 

Barry Carter, Chief of West Hempfield Fire and Rescue, advised that he will have the 2010 year-end

 report available for the April meeting of the board.  Ron Youtz reported that Dean Gantz will also have

 Mountville’s year-end report available at that time.

           

IV.  Subdivisions, Land Developments and Planning Modules

 

A.  Keystone Custom Homes – Chatsworth Development – Kayo Avenue – Request for Reduction in Letter of Credit

 

Edward Hinkle stated that the Township Engineer has recommended reduction of the letter of credit by $28,552.50 which leaves a balance of $100,650.00

 

Motion:  Edward Fisher moved, seconded by Anthony Crocamo, to approve a reduction in the letter of credit for Keystone Custom Homes by $28,552.50, leaving a balance of $100,650.00.  Carried 5-0.  

 

V.  New Business.

 

A.  Bid Award – Public Works Materials and Paving Project

 

Ron Youtz referenced Dale Getz’s memo with the results of the highway materials bids.

 

Motion:  Edward Fisher moved, seconded by Frank Burkhart, to award the highway material bids as noted in the 2/28/11 Memo by the Public Works Director: 1) Bituminous Materials FOB plant to Pennsy Supply/DBA Mcminn’s Asphalt at a total bid price of $95,701.00;  2) Stone Aggregate Materials FOB plant to County Line Quarry, Wrightsville, PA at a total bid price of $11,630.00;  3) Application of Bituminous Materials (3,000 tons delivered in place) to Pennsy Supply, Harrisburg, PA for a unit price of $63.94/ton and a total bid price of $191,820.00;  and 4) Precast Concrete Sanitary Sewer Manholes to Monarch Products Co., Inc. at a total bid price of $14,778.61.  Carried 5-0.

 

B.  2010 Annual Police Report

 

Chief Pugliese noted that crime was down in 2010, but that it was a busy year with the officers adapting to their role in policing Mountville Borough for the first time.  The Board acknowledged receipt of the Chief’s annual police report.

 

C.  2010 Annual Zoning Officers Report

 

Edward Hinkle advised that although the number of building permits are down, the value is up due to additions and renovations.  He also reported that nuisance complaints have increased. 

 

Kent Gardner asked how the mapping of storm water outfalls is proceeding.  Mr. Hinkle reported that the mapping is completed that will be necessary for MS4 compliance.  Mr. Gardner congratulated Mr. Hinkle for being ahead of the mandate. 

 

D.  Temporary Roadside Stands – Voluntary Sign Compliance

 

Ron Youtz stated that although the zoning ordinance will need to be amended at some time regarding signs for temporary roadside stands, Ed Hinkle would like to receive some feedback from farmers to help control the current situation without amending the ordinance.

 

Ed Hinkle noted that the Zoning Hearing Board has been providing guidelines by Special Exception with roadside stands that have too many signs or place them too close to the road.  Mr. Hinkle asked for the boards’ blessing to contact farmers and request voluntary compliance with a set of regulations concerning signs for roadside stands.  The board was in agreement with this approach.  

 

E.  Public Hearing – Ray Kreider – 652 Charelle Drive – Appeal of Enforcement Notice

 

Mr. Dumeyer noted that he was in receipt of a letter from Mr. Kreider’s attorney, Matthew Homsher, requesting withdrawal of the appeal of the November 23, 2010 Enforcement Notice following an inspection of the property with Township staff showing that the violations have been corrected.              

 

F.  Zoning Violation Consent Agreement – 740 Stony Battery Road

 

Ron Youtz explained that Josele Cleary has been in contact with the property owner’s attorney who has been unsuccessful in obtaining a signed consent agreement by today’s deadline.  Mr. Youtz then asked that the board authorize the Township Solicitor to proceed with enforcing the notice of zoning violations.

 

Motion:  Kent Gardner moved, seconded by Frank Burkhart, to authorize the Township Solicitor to move forward with the enforcement action of the property at 740 Stony Battery Road.  Carried 5-0.

 

VI.   Ordinances and Resolutions

 

None

           

VII.     Approval of Payables

 

Motion:  Kent Gardner moved, seconded by Frank Burkhart, for the payment of all bills coming due and payable in March and any residuals from February.  Carried 5-0.

VIII.   Adjournment to Executive Session to Discuss Zoning Ordinance Litigation Items

 

At this time, David Dumeyer recognized Teresa Bono who will be taking over the newspaper reporting assignment of the board meetings for Tom Knapp.  

 

Motion:  There being no further business to come before the Board, Edward Fisher moved, seconded by Kent Gardner, to adjourn to Executive Session at 8:10 p.m. to discuss zoning ordinance litigation items.  Carried 5-0.
